  • Clarify your residence status and the state you are moving to.
  • Ask your future employer about the group plan and plan start.
  • Plan interim cover for the USA until the plan starts.
  • With the Marketplace, check whether your status is eligible for the enrolment period and subsidies.
  • Ask the programme sponsor or university about minimum cover and deductible.

  • Ask your health fund or insurer until when the cover applies.

In detail

Everything about USA, step by step

The systemHow health insurance works in the USA

In the USA, cover through the employer is the most common form of health insurance. There are also Medicare, Medicaid and the Marketplace.

RouteWhat you clarify
Employer planIs there a plan, from when does it apply, who is covered?
MarketplaceDoes your status qualify, and which enrolment period applies?
MedicareDo you reach the age limit, and does your status qualify?
MedicaidDo you meet your state’s requirements?

The German Federal Foreign Office (Auswärtiges Amt) points out that treatment in the USA is given against advance payment or direct payment, and advises taking out evacuation insurance. Before the move, ask about the doctor network, advance payment and validity in the state.

Obligation and accessWhen you must be insured in the USA or get access

Check in this order: federal level, state, employer, residence status.

Federal level and state

Federal law and California are covered at the top in the introduction. For other states, ask the responsible authority whether there is a requirement.

Employer

Whether a group plan has a waiting period is stated in your offer. Ask from which day it applies, who is covered and how you bridge the time until then.

Marketplace

Access is covered at the top in the introduction, the enrolment period in the checkpoints. Ask the Marketplace whether your visa and moving date fit.

Medicaid and Medicare

ProgrammeWhat you clarify
MedicaidWhat requirements does your state have, and does your length of stay fit the waiting period?
MedicareWhen do you reach the entry age, and which contribution periods do you need?

Before a Medicaid application, ask an immigration adviser whether receiving it has consequences for your right of residence.

ProofWhen proof of health insurance is required

Whether you need proof depends on who asks.

Who asksWhat you need to knowWhere you ask
J-1 exchange visitorsMinimum cover and the programme sponsor’s duty are stated in the checkpoint “Proof for J-1”.With the programme sponsor
Immigrant visaProclamation 9945 of 2019, which denied entry to immigrants without certain health insurance or sufficient means, was revoked in 2021 by Proclamation 10209.With the US diplomatic mission: is health insurance information currently required?
MarketplaceFrom 1 January 2027, Marketplaces on the federal platform must verify eligibility for a special enrolment period in advance for at least three quarters of new enrolments; anyone who cannot prove it is not enrolled through it.With the Marketplace: which documents prove moving date and status?
University, employerTheir own requirements are possible, for example on minimum cover and deductible.Ask in writing

For visits with ESTA, see the note on travel insurance in the section “How health insurance works in the USA”.

OptionsYour options: local or international

You compare three routes: employer group plan, Marketplace plan and international health insurance.

OptionWhat you clarifyQuestion to the provider
Employer planWaiting period, coverage of dependants and doctor network according to the plan documents. From which day does the plan apply?
Marketplace planAccess, enrolment period and subsidies as stated in the introduction and checkpoints. Ask whether enrolment runs through healthcare.gov or a platform of your state.Does my status qualify, which documents are required?
International health insuranceArea of cover and conditions are stated in the contract. Whether a plan counts as qualifying coverage in a state with an insurance requirement is something you clarify with the state and the provider.Does the policy apply in the USA and in my state?

Check the area of cover, waiting periods, deductible and exclusions in the contract. More on how it is structured is in the guide International health insurance.

In GermanyWhat you clarify in Germany before you move

Before you deregister (Abmeldung) in Germany, you clarify in writing what happens to your current insurance. The questions below apply to any destination country. They are questions, not legal advice: the answers are in your contract documents or come from the body you ask.

The German-American social security agreement, in force since 1979, only covers pension insurance; health and long-term care insurance are not part of it.

If you have statutory insurance: questions for your Krankenkasse

  • What happens to my membership when I deregister in Germany, and on what date does it end?
  • Can I suspend the membership or take it up again later, and under what conditions?
  • What confirmation of my previous insurance periods do I receive, and how quickly?
  • What applies to co-insured family members: who stays insured and who does not?
  • Does the health fund still pay anything during a stay in the USA, and until which day?

If you have private insurance: questions for your insurer

  • Does my contract end with the move, is it suspended or does it continue?
  • Is there an Anwartschaft (a German option to keep certain rights in private insurance while abroad), and what is preserved under it? Ask about the difference between the small and the large Anwartschaft, and whether a new health assessment would be needed on a return.
  • Does my contract apply in the destination country, and for how long at a stretch?
  • Which documents do I receive in writing before I cancel?
  • Does the plan apply in the USA, and is medical repatriation included?

Do not cancel any contract before it is clarified in writing what applies afterwards. We explain the connections on the pages Health insurance when emigrating and PKV and Anwartschaft. For families, there is more at Health insurance for the family abroad.

Stumbling blocksTypical mistakes with health insurance for the USA
  1. Confusing the penalty with the requirement

Check your state’s rules separately from federal law and ask there.

  2. Overlooking the gap until the plan starts

Between arrival and the plan start, a period without cover can arise. Check whether interim cover includes the USA.

  3. Counting on Medicaid

Ask the state authority beforehand whether your status and length of stay are sufficient.

  4. Choosing an international plan without checking the area of cover

Check in the contract whether the USA and your state are included.

FAQ

Frequently asked questions about USA

Do I have to be health insured in the USA?

Under federal law the penalty for lacking health insurance is set to zero, while California has required coverage, an exemption or a penalty payment since 2020.

Whether the state you are moving to has its own rule is something you clarify there with the tax or health authority. Ask which exemptions exist and which plans count as qualifying coverage.

Which access you have depends on status and employer. The checkpoints above list the routes with sources. Also ask from when a requirement applies to new arrivals.

Sources: [1], [2]

Can I use the Marketplace as a new arrival?

The Marketplace may be used by citizens, nationals and lawfully present non-citizens who intend to live in the state, for example with a valid work or student visa, if the status is expected to apply for the whole enrolment.

When you can enrol after the move and how coverage begins is stated in the checkpoint “Marketplace on arrival”. Ask the Marketplace whether your visa, moving date and state fit the rules.

Gather documents on your moving date and residence status beforehand and ask which proof is required and how long the check takes. Also ask whether family members travelling with you need their own documents.

Sources: [3], [4], [5], [18]

When does cover through the employer begin?

An employer’s group plan may apply a waiting period of at most 90 days.

When your plan actually begins is stated in your employer’s plan documents. Before accepting, ask about the first day of coverage, coverage of partner and children, and the doctor network.

For the time until the plan starts you need interim cover. Clarify with the insurer whether the cover includes the USA and how long it runs. Have both confirmed in writing. Also ask what applies when the employment ends.

Do I need proof of health insurance for my stay?

That depends on your visa and on the body that asks.

Programme sponsors must require insurance for J-1 exchange visitors and accompanying spouses and children that covers at least US$100,000 per accident or illness, US$25,000 for the repatriation of mortal remains and US$50,000 for medical evacuation, with a deductible of at most US$500. For other visas, ask the US diplomatic mission whether health insurance information is currently required.

An overview by body is given in the table in the section “When proof of health insurance is required”. Have the confirmation ready before you leave.

Does my German health fund pay in the USA?

The German-American social security agreement, in force since 1979, only covers pension insurance; health and long-term care insurance are not part of it.

Whether and for how long your health fund (Krankenkasse) still pays during a stay in the USA is something you clarify beforehand with the fund. Also ask your private insurer what applies until the day of the move and whether repatriation is included.

Notes on care and travel insurance are in the travel and safety advice of the German Federal Foreign Office (Auswärtiges Amt). Keep every commitment in writing so that you can prove it later, and keep the documents.
